1. RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT 

BY PROVIDING PAYMENT IT ACTS AS SIGNING THIS FORM YOU GIVE UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY!

 

The Participant acknowledges that Regina Sports Performance Centre Inc. and its faculty, staff, students, volunteers, members, representatives, shareholders, directors, officers, employees or contractors (all hereafter collectively referred to as “RSPC”) are not and shall not be held responsible for any injury, loss or damage of any kind sustained by the Participant or any other person while participating in or at the RSPC’s performance centre situated at 1464 Broadway Avenue, Regina, Saskatchewan (the “Centre”), RSPC’s or any other person’s personal training services and/or performance related training, and/or engaging or participating in any other activity at the Centre (collectively referred to as the “Activity”), including injury, loss or damage which might be caused or attributed to the negligence of RSPC. In consideration of RSPC allowing the Participant to participate in the Activity, the Participant:

 

1. Represents that the Participant is qualified, in good health and in proper physical condition to participate in the Activity, and that the Participant has not experience fever, dry cough, shortness of breath, difficulty breathing, or any other COVID-19 related symptoms in the last 14 days (“COVID-19 Related Symptoms”). The Participant further agrees that if at any time the Participant believes the conditions to be unsafe, the Participant will immediately discontinue further participation in the Activity. The Participant further agrees that if at any time the Participant begins to experience COVID-19 Related Symptoms, the Participant will not attend upon the Centre unless and until such time as the Participant has received confirmation that the Participant is not infected with COVID-19 or cannot transmit the virus;

2. Acknowledges that the Activity may involve risks and dangers of serious bodily injury, including, without limitation, permanent disability, paralysis, death, and contracting communicable diseases (“risks”); these risks and dangers may be caused by the Participant’s own actions or inactions, the actions or inactions of other participants in the Activity and/or Centre, the condition in which the Activity takes place, or the negligence of RSPC; there may be other risks and social and economic losses;

3. Agrees to assume and accept all risks arising out of, associated with or related to the Participant’s participation in the Activity, even though such risks my have been caused by or contributed to in any way by the negligence of RSPC;

4. Agrees to be solely responsible for any injury, loss or damage that the Participant might sustain while participating in the Activity, even though such injury, loss or damage may have been caused by or contributed to in any way by the negligence of RSPC;

5. Releases, discharges, and covenants not to sue RSPC from all liability, claims, demands, losses or damages on the Participant’s account caused or alleged to be caused for any reason whatsoever, including without limitation in whole or in part by the negligence of RSPC or otherwise, including negligent rescue operations;

6. Agrees to hold harmless and indemnify RSPC from any and all liability for any damage to the property of, or personal injury to, any third party resulting from the Participant’s participation in the Activity; and

7. Agrees to indemnify and hold harmless RSPC from any and all claims, demands, actions and costs, including legal costs incurred by RSPC on a full indemnity basis, which might arise out of the Participant’s participating in the Activity even though such claims, demands, actions and costs may have been caused by or contributed to in any way by the negligence of RSPC. I understand that this is a legal agreement. It is binding upon myself as well as upon my heirs, executors and representatives in the event of my death or incapacity. I have read and understood all the terms of this agreement, and by signing this agreement voluntarily, I am agreeing to abide by these terms. 

 

 

 

2. CAMP WAIVER AND PHOTO RELEASE

By signing my child up for these Lacrosse development camps, I am agreeing that I understand Lacrosse is a physical sport and there are risks with taking part and I am voluntarily signing the participation up to take part knowing and understanding the risks associated. I agree the participate will play under the auspices of the SLA, its officers, successors, member associations, Jeff Shattler Lacrosse Academy and anyone acting on their behalf, and I hold the Saskatchewan Lacrosse Association, it’s officers, successors, member associations, Jeff Shattler Lacrosse Academy and anyone acting on their behalf free and clear from all manner of litigation, damage claims or demands in law or in equity which may have legal recourse by reason of personal injury (including death) to myself or the participate, loss or damage to myself or the participant or property resulting from anyone acting on their own behalf, which may occur during or by reason of my participating in this camp. I understand that the participant can be removed from the camp, with out any fee reimbursement, if they are not following the rules and policies of the camp or Saskatchewan Lacrosse Association or are being a danger to themselves or other participants. I recognize that these camps are sanctioned by the Saskatchewan Lacrosse Association, and therefore my player will abide by all the SLA Harassment and Code of Conduct requirements and my player is subject to SLA discipline should they fail for adhere to those said requirements and they can be removed from the camp, with no refund, as well. I give consent to the Saskatchewan Lacrosse Association and all of its’ Member Associations, Programs, Members, Partners (ex. Saskatchewan Rush), and Jeff Shattler, and Shattler Lacrosse Academy permission to use any pictures or videos of the participant on all communication tools. This includes all print, electronic, and social media communication used to advertise or promote the Saskatchewan Lacrosse Association and any of its Member Associations, Programs, Members, Partners and Jeff Shattler Lacrosse Academy.

 

 

3. COVID – 19 WAIVER SASKATCHEWAN LACROSSE ASSOCIATION AND REGINA LAX DEVELOPMENT CAMPS AND SHATTLER LACROSSE ACADEMY RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT (To be executed by Participants over the Age of Majority) WARNING! Please read carefully By signing this document, you will waive certain legal rights – including the right to sue

1. This is a binding legal agreement. Clarify any questions or concerns before signing. As a participant in the sport of Lacrosse and the spectating, orientation, instruction, activities, competitions, programs, and services of Saskatchewan Lacrosse Association, Regina Lax Development Camps, and Shattler Lacrosse Academy (collectively the “Activities”), the undersigned acknowledges and agrees to the terms outlined in this document.

 

Disclaimer

2. Saskatchewan Lacrosse Association and its Member Association/Association Members/Sanctioned Entities and their respective Directors, Officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facilities in which the Activities take place, and representatives (collectively the “Organization”) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by a Participant during, or as a result of, the Activities, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

 

Description and Acknowledgement of Risks

3. I understand and acknowledge that

4. The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life;

5. The Organization may offer or promote online programming (such as webinars, remote conferences, workshops, and online training) which have different foreseeable and unforeseeable risks than in-person programming;

6. The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of my fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used might malfunction; and

 

COVID-19

7. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that I will not become infected with COVID-19. Further, participating in the Activities could increase my risk of contracting COVID-19. 8. I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers and hazards associated with or related to the Activities. The risks, dangers and hazards include, but are not limited to: a. Contracting COVID-19 or any other contagious disease b. The sport of Lacrosse c. Privacy breaches, hacking, technology malfunction or damage while interacting with online training; d. Executing strenuous and demanding physical techniques; e. Dryland training including weights, running, bands, and massage; f. Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements; g. Exerting and stretching various muscle groups; h. Physical contact with other participants; i. Failure to act safely or within my own ability or designated areas; j. All physical risks of taking part in a contact activity like Lacrosse k. The failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment; l. Serious injury to virtually all bones, joints, ligaments, muscles, tendons and other aspects of my body or to my general health and well-being; m. Abrasions, sprains, strains, fractures, or dislocations; n. Concussion or other head injuries, including but not limited to, closed head injury or blunt head trauma; o. Spinal cord injuries which may render me permanently paralyzed; p. Negligence of other persons, including other spectators or, participants, or employees; q. Travel to and from competitive events and associated non-competitive events which are an integral part of the Activities; and r. Negligence on the part of the Organization, including failure by the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with my participation in the Activities.

 

Terms

9. In consideration of the Organization allowing me to participate in the Activities, I agree:

10. That when I practice or train in my own space, I am responsible for my surroundings and the location and equipment that I select;

11. That my mental and physical condition is appropriate to participate in the Activities and I assume all risks related to my mental and physical condition;

12. To comply with the rules and regulations for participation in the Activities;

13. To comply with the rules of the facility or equipment;

14. That if I observe an unusual significant hazard or risk, I will remove myself from participation and bring my observations to a representative of the Organization immediately;

15. The risks associated with the Activities are increased when I am impaired and I will not to participate if impaired in any way;

16. That it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an Activity, I acknowledge and accept the suitability and conditions of the Activity;

17. That COVID-19 is contagious in nature and I may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death; and

18. That I am responsible for my choice of safety or protective equipment and the secure fitting of that equipment.

 

Release of Liability and Disclaimer

19. In consideration of the Organization allowing me to participate, I agree:

20. That the sole responsibility for my safety remains with me;

21. To ASSUME all risks arising out of, associated with or related to my participation;

22. That I am not relying on any oral or written statements made by the Organization or its agents, whether in a brochure or advertisement or in individual conversations, to agree to participate in the Activities;

23. To WAIVE any and all claims that I may have now or in the future against the Organization;

24. To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from my participation in the Activities;

25. To FOREVER RELEASE AND INDEMNIFY the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization;

26. To FOREVER RELEASE AND INDEMNIFY the Organization from any action related to my becoming exposed to or infected by COVID-19 as a result of, or from, any action, omission or negligence of myself or others, including but not limited to the Organization;

27. That the Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of the Activities;

28. That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities; and

29. This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of Saskatchewan and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

 

Jurisdiction

30. I agree that in the event that I file a lawsuit against the Organization, I will do so solely in the Province of Saskatchewan and further agree that the substantive law of the Province of Saskatchewan will apply without regard to conflict of law rules.

 

Acknowledgement

31. I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives. I further acknowledge by signing this agreement I have waived my right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.

 

 

4. COVID – 19 DECLARATION SASKATCHEWAN LACROSSE ASSOCIATION COVID-19 DECLARATION COMPLIANCE The Saskatchewan Lacrosse Association, Regina Lax Development Camps, and Shattler Lacrosse Academy, (collectively the “Organization”) requires disclosure of exposure or illness is in order to safeguard the health and safety of all participants and limit the further outbreak of COVID-19.

 

This Declaration of Compliance will be kept safely, and personal information will not be disclosed unless as required by law or with your consent. A Participant (or the Participant’s parent/guardian, if the Participant is under the age of majority) who is unable to agree to the terms outlined in this document is not permitted to participate in the Organization’s activities, programs, or services at this time. I, the undersigned being the Participant and the Participant’s Parent/Guardian (if the Participant is under the age of majority), hereby acknowledge and agree to the terms outlined in this document:

• The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19 and requires all participants (or their parent/guardian, when applicable) to adhere to the compliance standards described in this document.

• The Participant has not been diagnosed with COVID-19, OR if the Participant was diagnosed with COVID-19, the Participant was cleared as noncontagious by provincial or local public health authorities more than 14 days prior to the date this Declaration of Compliance was signed.

• The Participant has not been exposed to a person with a confirmed or suspected case of COVID-19; OR if the Participant was exposed to a person with a confirmed or suspected case of COVID-19, the date of exposure was more than 14 days prior to the date this Declaration of Compliance was signed.

• The Participant is participating voluntarily and understands and assumes the risks associated with COVID19. The Participant (or the Participant’s parent/guardian, on behalf of the Participant (when applicable)) agrees to assume those risks, including but not limited to exposure and being infected.

• The Participant has not, nor has anyone in the Participant’s household, experienced cold or flu-like symptoms in the last 14 days (including fever, cough, sore throat, shortness of breach, respiratory illness, difficulty breathing).

• If the Participant experiences, or if anyone in the Participant’s household experiences, any cold or flu-like symptoms after submitting this Declaration of Compliance, the Participant will immediately isolate and not attend any of the Organization’s activities, programs or services until at least 14 days have passed since those symptoms were last experienced.

• The Participant has not, nor has any member of the Participant’s household, travelled to or had a lay-over in any country outside Canada, or in any Province outside of Saskatchewan in the past 14 days. If the Participant travels, or if anyone in the Participant’s household travels, outside the Province of Saskatchewan after submitting this Declaration of Compliance, the Participant will not attend any of the Organization’s activities, programs or services until at least 14 days have passed since the date of return.

• The Participant is following recommended guidelines, including but not limited to, practicing physical distancing, trying to maintain separation of six feet from others, frequent handwashing, and otherwise limiting exposure to COVID-19.

• The Participant will follow the safety, physical distancing and hygiene protocols of the Organization.

• This document will remain in effect until the Organization, per the direction of the provincial government and provincial health officials, determines that the acknowledgements in this Declaration of Compliance are no longer required.

• The Organization may remove the Participant from participation in the activities, programs or services of the Organization at any time and for any reason if the Organization believes, in its sole discretion, that the Participant is no longer in compliance with any of the compliance standards described in this document.

 

 

 

 

5.COVID – 19 ASSUMPTION OF RISK Saskatchewan Lacrosse Association INFORMED CONSENT AND ASSUMPTION OF RISK AGREEMENT (To be executed by Participants under the Age of 18) WARNING! Please read carefully

 

By signing this document, you will assume certain risks and responsibilities

1. This is a binding legal agreement. Clarify any questions or concerns before signing. As a participant in the sport of Lacrosse and the spectating, orientation, instruction, activities, competitions, programs, and services of Saskatchewan Lacrosse Association and its registered Member Associations, Association Members, and Sanctioned Entities, Regina Lax Development Camps, and Shattler Academy (collectively the “Activities”), the undersigned, being the Participant and the Participant’s Parent/Guardian (collectively the “Parties”), acknowledge and agree to the terms outlined in this document.

The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that the Participant will not become infected with COVID-19. Further, participating in the Activities could increase the Participant’s risk of contracting COVID-19.

8. The Participant is participating voluntarily in the Activities. In consideration of that participation, the Parties hereby acknowledge that they are aware of the risks, dangers and hazards and may be exposed to such risks, dangers and hazards. The risks, dangers and hazards include, but are not limited to: a. Contracting COVID-19 or any other contagious disease; b. The sport of Lacrosse; c. Privacy breaches, hacking, technology malfunction or damage while interacting with online training; d. Executing strenuous and demanding physical techniques; e. Dryland training including weights, running, bands, and massage; f. Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements; g. Exerting and stretching various muscle groups; h. Physical contact with other participants; i. Failure to act safely or within my own ability or designated areas; j. All risks of playing a contact sport like Lacrosse k. The failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment; l. Serious injury to virtually all bones, joints, ligaments, muscles, tendons and other aspects of my body or to my general health and well-being; m. Abrasions, sprains, strains, fractures, or dislocations; n. Concussion or other head injuries, including but not limited to, closed head injury or blunt head trauma; o. Spinal cord injuries which may render me permanently paralyzed; p. Negligence of other persons, including other spectators or, participants, or employees; and q. Travel to and from competitive events and associated non-competitive events which are an integral part of the Activities.

9. In consideration of the Organization allowing the Participant to participate in the Activities, the Parties agree:

10. That when the Participant practices or trains in their own space, the Parties are responsible for the Participant’s surroundings and the location and equipment that is selected for the Participant;

11. That the Participant’s mental and physical condition is appropriate to participate in the Activities and the Parties assume all risks related to the Participant’s mental and physical condition

12. To comply with the rules and regulations for participation in the Activities;

13. To comply with the rules of the facility or equipment;

14. That if the Participant observes an unusual significant hazard or risk, the Participant will remove themselves from participation and bring their observations to a representative of the Organization immediately;

15. The risks associated with the Activities are increased when the Participant is impaired and the Participant will not participate if impaired in any way;

16. That it is their sole responsibility to assess whether any Activities are too difficult for the Participant. By the Participant commencing an Activity, they acknowledge and accept the suitability and conditions of the Activity

17. That COVID-19 is contagious in nature and the Participant may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death; and

18. That they are responsible for the choice of the Participant’s safety or protective equipment and the secure fitting of that equipment.

19. In consideration of the Organization allowing the Participant to participate, the Parties agree:

20. That the Parties are not relying on any oral or written statements made by the Organization or their agents, whether in brochure or advertisement or in individual conversations, to agree to participate in the Activities;

21. That the Organization is not responsible or liable for any damage to the Participant’s vehicle, property, or equipment that may occur as a result of the Activities; and

22. That this Agreement is intended to be as broad and inclusive as is permitted by law of the Province of Saskatchewan and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

 

Jurisdiction

23. The Parties agree that in the event that they file a lawsuit against the Organization, they agree to do so solely in the Province of Saskatchewan and they further agree that the substantive law of the Province of Saskatchewan will apply without regard to conflict of law rules.

 

Acknowledgement

24. The Parties acknowledge that they have read this agreement and understand it, that they have executed this agreement voluntarily, and that this Agreement is to be binding upon themselves, their heirs, their spouses, parents, guardians, next of kin, executors, administrators and legal or personal representatives.

COVID-19 TRAVEL WAIVER

 

Due to the COVID-19 pandemic, the Province of Saskatchewan is not recommending travel for anything not deemed not essential, which includes sports. If a player would like to travel to attend a camp or clinic their parents agree to the following

• The player/guardian understands they must attend the closest camp to their location offering the level and sector of play they are wanting to take part in.

• The player/guardian understands that by traveling for the camp they are going against the recommendations of the Province of Saskatchewan and Saskatchewan Health Authority and are choosing to go against those recommendations on their own free will.

• The player/guardian understands that the Saskatchewan Lacrosse Association also does not recommend travel based on the recommendations of the Province of Saskatchewan and Saskatchewan Health Authority and they are choosing to against those recommendations on their own free will and the SLA is not responsible for the decision to travel.

• The player/guardian accepts responsibility for all risks involved with going against the above-mentioned recommendations.

• The player/guardian understands that approval of travel is under the discretion of the Saskatchewan Lacrosse Association and that approvals can be revoked at any time.

• The player/guardian understands the COVID-19 risks associated by traveling for a camp/clinic, not only to themselves but to the other players taking part.

• The player must successfully complete a Health Check screen as per the SLA Return to Lacrosse Plan before participating and must provide all contact tracing information to the camp as required.
